Gfinder ACCOUNT TERMS OF USE

General Provisions

Article 1: Definitions

  1. "Terms of Use" means these Terms, together with any amendments and additions made from time to time at the decision of the Service Provider, setting out the terms, conditions, rights and responsibilities of the User with respect to using the Services provided by Gfinder VN.
  2. "Gfinder Account" means an account registered, managed and maintained by the User to use the Services provided by the Service Provider.
  3. "Service Provider" or "Gfinder VN" means Gfinder Online Media Joint Stock Company, a company lawfully established under the laws of Vietnam.
  4. "User" means an individual or organization holding a Gfinder Account on the System in order to use the products.
  5. "System" means the technical platform and infrastructure used to provide the Services to Users.
  6. "Personal Information" means information such as full name, date of birth, national ID number, address (permanent or temporary residence), email address, mobile or landline phone number, login username and PIN used to access the System.
  7. "Business Day" means a day other than Saturday, Sunday, or a public holiday / compensatory day off under Vietnamese law.
  8.  "OTP" (One Time Password) is a single-use password. OTP Mobile is a one-time-password generator application developed by Gfinder VN to reduce risks that may arise when logging in to a Gfinder account.
  9. "Linked account" means using a Yahoo, Google or Facebook account to log in to a Gfinder ACCOUNT.

Article 2: Principles of Gfinder account registration

  1. The User bears full responsibility for all information provided when registering a Gfinder account, and for any subsequent changes or additions to that information.
  2. In addition to complying with these Gfinder Terms of Use, the User must strictly comply with any other agreements, regulations and procedures of Gfinder VN that are publicly posted on the website of the relevant Gfinder VN product.
  3. The User must not register an account using the name of a public figure, a leader of the Communist Party or the State, the name of a criminal, reactionary or terrorist individual or organization, or any account name with unwholesome meaning contrary to social customs and traditions.
  4. When using a Gfinder VN product, the User must choose a product appropriate to their age and strictly comply with the agreements of that specific product as publicly posted on the product's website.

Article 3: Prohibited acts

It is strictly prohibited to take advantage of the provision or use of Internet services and online information for the purpose of:

  1. Disclosing state secrets, military, security, economic, foreign-affairs secrets, or any other secrets prescribed by law.
  2. Publishing distorted or slanderous information that damages the reputation of an organization or the honor and dignity of an individual.
  3. Advertising, promoting, buying or selling prohibited goods or services; disseminating prohibited press works, literary or artistic works, or publications.
  4. Unlawfully obstructing, disrupting or sabotaging national domain name server systems or Internet/information service infrastructure; obstructing lawful access to information or lawful use of Internet services by organizations or individuals.
  5. Unlawfully using the passwords or cryptographic keys of organizations or individuals, private information, personal data, or Internet resources.
  6. Impersonating an organization or individual, or spreading fabricated or false information online that infringes the lawful rights and interests of organizations or individuals.
  7. Creating unauthorized links to the domain names of organizations or individuals. Creating, installing or spreading malicious software or computer viruses; unlawfully intruding into or seizing control of information systems; building attack tools targeting the Internet.
  8. Absolutely no use of any program, tool or other means to interfere with Gfinder VN's products.
  9. Strictly prohibited to spread, disseminate or promote any activity intended to interfere with, sabotage, or intrude into the data of the products provided or of the server systems.
  10. No act intended to gain unauthorized access, or to attempt unauthorized access, or to cause damage to the server systems, is permitted.
  11. Buying or selling a Gfinder account for real money or cash is not accepted.
  12. When communicating with other players, the User must not harass, insult, disturb, or engage in any uncultured behavior toward other players.
  13. It is absolutely forbidden to insult or mock others in any form whatsoever (mockery, belittling, discrimination based on religion, gender, ethnicity, etc.).
  14. No conduct or attitude that damages the reputation of Gfinder VN's products, in any form or manner, is permitted.
  15. Strictly prohibited to promote any product in any form, including but not limited to sending or transmitting any advertising message, solicitation, chain letter, or investment opportunity through Gfinder VN's products without the prior written consent of Gfinder VN.
  16. Strictly prohibited to organize betting, gambling, or any agreement involving money, cash or goods of value.
  17. Strictly prohibited to sabotage Gfinder VN's products in any form whatsoever.

Regulations on Registration and Login

Article 4: Registration

  1. Before registering an account, the User confirms that they have read, understood, and agreed to all provisions of these Gfinder Terms of Use.
  2. Account holder age requirements:
    • For games featuring combat activity involving weapons (with no pornographic activity, imagery or sound): age 18 and above.
    • For games featuring combat or fighting activity involving weapons where weapon imagery is not shown in clear close-up, where the sound of weapon impacts during combat is toned down, and with no activity, imagery, sound, or characters featuring nudity, pornography, or close-ups drawing attention to sensitive body parts: age 12 and above.
    • For animation-style simulation games with no weapon-based combat activity; no ghostly, horror or violent imagery or sound; and no imagery, activity, sound or characters featuring nudity, pornography, or close-ups drawing attention to sensitive body parts: all ages. (Per Section 1, Article 4 of Circular 24/2014/TT-BTTTT)
  3. When registering an account, the User must provide complete and accurate Personal Information, including full name, age, contact address, identification documents, registration email, account-protection phone number, and security question and answer, and is responsible for the information provided. The User may register a linked account to log in to their Gfinder account. Where the account holder is under 14 years of age and does not yet have a national ID card or passport, the player's legal guardian shall decide on registering the player's personal information, thereby expressing consent and accepting legal responsibility for that registration. (Per Section 1, Article 6 of Circular 24/2014/TT-BTTTT)
  4. Should a risk arise during use, Gfinder VN will rely on the information provided by the User to receive and resolve the matter. Gfinder VN will only receive and resolve cases where the information required under clause 2 of this Article was entered correctly, accurately and completely. Where such information was entered incompletely or inaccurately, the User will not receive any support from Gfinder VN during use, and Gfinder VN will not be responsible for resolving any disputes or risks arising with respect to that account.

Article 5: Use of account and password

  1. After completing registration, the User will be provided with one (01) account and account number. With this account, the User may access and use some or all of Gfinder VN's products.
  2.  Each account will have one password.
  3.  The User is responsible for safeguarding their own password; if the password is disclosed in any form, Gfinder Online will not be responsible for any resulting loss.
  4.  Gfinder VN reserves the right to delete a User's account if the account is not used to log in to any Gfinder VN product within 30 days of the registration date.
  5.  Gfinder VN reserves the right to delete a User's account if the account is not used to log in to any Gfinder VN product for 1 (one) year from the date of last use.

Article 6: Login

  1. The User will use the account they registered and that was provided by Gfinder Online to log in to and use some or all of Gfinder VN's products.
  2. In addition to using a Gfinder account to log in, the User may use a phone number, email, or a linked account to log in to Gfinder. By using this convenience feature, the User agrees to accept all potential risks that may arise.
  3. To log in to Gfinder via a linked account, the User must complete the account-linking registration steps and accept the terms of use for this feature, confirming that the User has read, fully understood, and accepted both the convenience and the risks of using this login feature.

RIGHTS AND RESPONSIBILITIES

Article 7: Rights of the account holder

  1. The User has the right to change or update account information: password; identification documents; registered email; security question and answer; and account-protection phone number.
  2. The User will be guided on setting a secure password; using the on-screen virtual keyboard; entering important information to protect the account; adding or changing the phone number used to top up GFcoin via the account-protection phone number; registering an account-protection phone number; locking the account; using the OTP application when logging in; and using a linked account to log in.
  3. The User has the right to gift/transfer a Gfinder Account to another person. This right applies only to accounts that have registered complete and accurate account information in accordance with these Gfinder Terms of Use.
  4. Exercise other rights as provided by law.

Article 8: Responsibilities of the account holder

  1.  To receive support from Gfinder VN, the User's account must be registered with complete, truthful and accurate information. If any information changes or needs to be supplemented, the User must update it with us immediately, following the instructions posted on the Service website. The User warrants that their account information is at all times current, complete, truthful and accurate, and that the User bears full responsibility for all information they provide.
  2. The User is responsible for keeping account information confidential, including: password, account-protection phone number, identification documents, account-protection email, and linked accounts. If any of the above information is disclosed in any form, the User must accept the resulting risks. Gfinder VN will rely on the information currently held in the account as the basis for determining account ownership in the event of a dispute, and Gfinder VN will not be responsible for any resulting loss. Identification document information registered on the account is the most important information for proving account ownership.
  3. The User agrees to promptly notify Gfinder VN of any unauthorized use of the User's account and password, or of any act that breaches system security. The User also warrants that they will always log out of their account after each use.
  4.  Upon discovering a product bug or any issue affecting the normal operation of Gfinder VN or related products, please notify us via the admin mailbox.
  5. The User commits to being responsible for the lawful use of any digital content they post on the Internet and telecommunications networks.
  6. The User may be subject to administrative penalties or criminal prosecution if the User infringes copyright or related rights while using Gfinder VN's online social network.
  7. The User must strictly comply with the prohibited acts set out in Article 3 of this agreement. In the event of one or more violations, depending on the severity, Gfinder VN will permanently lock the account, revoke all of the User's benefits with respect to Gfinder VN's products, and, where necessary, request that the competent authorities prosecute the User under the law.
  8. Perform other responsibilities as provided by law.

Article 9: Rights of Gfinder VN

  1. If a User is found to have violated the provisions stated in this Agreement, we have the right to block or refuse access for any account without prior notice. In serious cases, Gfinder VN will cooperate with the authorities to hold violators accountable. Details of violations are specified in the "Handling of Violations" section.
  2. We have the right to use account information to send notifications to the account holder about products, services, or promotional programs via email or postal mail. We may also use this information to conduct investigations (for example: notifying of service changes within the System, notifying of promotional programs, or other humanitarian and social activities). We maintain a "NO SPAM" policy and do not share, sell, or leak the account holder's email to third parties.
  3. We have full authority to change any terms or policies in this agreement that we consider no longer appropriate, without prior notice; the User is deemed to automatically agree to comply with the amendments under the new provisions.
  4. For accounts that violate the above terms, we have full authority to lock the account without prior notice, refuse to continue providing services to the account holder, and revoke all benefits depending on the severity of the violation.
  5. We will only provide the account holder's personal information and/or IP address when required by Vietnamese law enforcement authorities and for genuinely necessary purposes such as:
    • Cooperating with investigating authorities to identify illegal activities related to the spread of information and cybersecurity.
    • Protecting rights and property related to the service system we provide.
    • Identifying persons who deliberately violate information and cybersecurity laws.
  6. In events organized by Gfinder VN, we reserve the right to cancel a customer's prize if the account information does not belong to the actual customer, or if illegal trading between accounts is detected.
  7. Gfinder VN has the right to run system logs to check for and remove hacked items, without needing the User's consent and without bearing any liability to the User.
  8. Gfinder VN may terminate accounts of account holders who violate rules regarding the trading of Stars/GFcoin in any form, without any prior notice.

Article 10: Responsibilities of Gfinder VN

  1. Responsible for supporting the User while using Gfinder VN's products.
  2. Receive and resolve customer complaints arising during the use of Gfinder VN's products; however, Gfinder VN will only support, receive and resolve complaints for accounts that registered complete, truthful and accurate information.
  3. Responsible for keeping the User's personal information confidential; Gfinder VN does not sell or exchange this information with third parties, except as required by law or with the User's consent.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY

Article 11

  1. Gfinder VN will not be liable for any system-related issue arising when the User registers for or logs in to a Gfinder account.
  2. When the User registers for or uses the login feature via a linked account, this means the User's information will be shared with a third party. The User accepts this sharing and any associated potential risks (if any). The User releases Gfinder VN from liability related to the User's information or data being shared with that third party.
  3.  For digital content and entertainment products, we always strive to meet product standards and aim to provide customers with a good product and service experience. However, we are not obligated to guarantee those standards. Factors beyond our control may result in product defects. We will make reasonable efforts to fix product defects to the satisfaction of our customers, and we are not responsible for supporting or compensating customers for the risks described above.

Article 12

In the event of risk or damage arising from force majeure events, including but not limited to power surges, hardware or software failure, internet connectivity incidents, or natural disasters, etc., the user must accept any resulting risk or damage. Gfinder VN commits to making reasonable efforts to minimize any such risk or damage; however, Gfinder Online will not bear any liability arising in these cases.

Article 13

  1. GFcoin cards/card codes that have been purchased, and GFcoin that has been topped up, are non-refundable under any circumstances.
  2.  Gfinder VN bears absolutely no liability or risk for any transaction between the User and a third party during the use of Gfinder VN's products. When the User uses a product and/or transacts with a third party, the User has understood and agreed to bear sole responsibility for any resulting risks.

PRIVACY PROTECTION POLICY

Article 14

Gfinder VN always places great importance on protecting Users' information. To protect Users' rights more effectively, we have published a Privacy Policy at golay.vn explaining in detail how we protect information. Please review the Privacy Policy to understand how Gfinder VN collects and uses information linked to your Account and/or your use of the Services. By using the Services or agreeing to these Terms of Service, the User agrees to allow Gfinder VN to collect, use, disclose and/or process Content and personal data as described in this Privacy Policy.

Article 15

Any user who holds the personal data of another user (the "Receiving Party") must (i) comply with all applicable personal data protection laws; (ii) allow the other user (the "Disclosing Party") to remove their own name from the Receiving Party's database; and (iii) allow the Disclosing Party to view the information the Receiving Party has collected about them.

INTELLECTUAL PROPERTY AND OTHER RIGHTS POLICY

Article 16

All intellectual property rights existing in Gfinder Online's products belong to Gfinder VN or are lawfully licensed to Gfinder Online for use, and accordingly all lawful rights are protected. Unless consented to by Gfinder VN, the User is not permitted to upload, send, publish, reproduce, transmit or distribute, in any form, any component of Gfinder VN's products.

Article 17

In areas where posting content is permitted, the User may share permitted information in the formats we specify by default, and the User is solely responsible for the content, information, images, and any other sharing, as well as the legality and legal liability of the content, information, and sharing by the User toward an individual User, group of Users, or organization. Nevertheless, in all cases, we reserve the right to handle posted information so that it conforms to social customs, ethical standards, and rules ensuring national security, and we have full authority to allow or disallow the User's post to appear or remain on the forum or in areas where sharing information is permitted.

Article 18

We have full rights, including but not limited to copyright, trademark, trade secret and other proprietary rights, in all of Gfinder VN's products. Use of our rights and property requires our prior written permission. Other than a grant of permission in writing, we do not license, whether by publication or implication, any of the above rights to the User. Accordingly, the User has no right to use our products for commercial purposes without our prior written permission.

Article 19

The User agrees that we may freely use, disclose, apply and modify any idea, concept, method, proposal, suggestion, comment or other form of feedback that the User provides to us through the use of Gfinder VN's products, entirely free of charge. The User waives, and agrees to waive, any right or claim to any reward, fee, royalty, or other form of payment related to our use, disclosure, application, or modification of any or all of the User's feedback.

COMPLAINTS, REPORTS AND COMPENSATION

Article 20: Complaints

  1.  Because system storage space is limited, customer transaction information will only be stored and displayed on the Gfinder VN account system for 30 days from the date the transaction occurred. This is also the period during which Gfinder VN supports complaint resolution. After this period, the Gfinder Online account holder loses the right to file a complaint regarding that transaction.
  2.  When reporting or filing a complaint against another account, you must clearly state the name of the account being reported and the violation committed by that account. To have your rights protected, please provide all three pieces of information about your own account (namely: national ID number, security question and answer, and the email address used at registration) along with the necessary contact details.
  3.  During the reporting/complaint process, you may request that support staff lock your account in order to protect your assets and preserve any remaining GFcoin balance.
  4.  In the case of a false report or complaint regarding GFcoin hacking, your account will be locked as a penalty for a period of 2 weeks.
  5.  Where a dispute requires a face-to-face confrontation of the parties, we are responsible for notifying you of the specific time. You or your authorized representative must be present at: the company's complaint resolution office, at the location and time notified.

Article 21: Transaction history

  1. The Gfinder VN account system allows the account holder to look up transaction history for the most recent 30 days counting back from the time of inquiry.
  2.  Where the account holder wishes to look up transaction history for a period exceeding 30 days, please contact our Hotline for support.

Article 22

For disputes between Users, or between a User and Gfinder VN, Gfinder VN will rely on system logs to resolve the matter. Accordingly, Gfinder VN will protect, to the greatest extent possible, the interests of Users who have registered complete information as required. Gfinder VN's decision is final.

Article 23

The User agrees to defend, indemnify and hold Gfinder VN harmless from any legal obligations, proceedings, losses, or costs, including but not limited to court fees and attorney or consultant fees, arising from or related to resolving a breach by the User in the course of using Gfinder VN's products.

Article 24: Effective terms

This Terms of Use agreement binds us from the time it is published on the website https://gfinder.vn and binds you, our valued customer, from the time you register to use the service provided at https://gfinder.vn. When any amendment or addition is published, both we and you must comply with the amendments and additions we issue.

HANDLING OF VIOLATIONS

Gfinder VN sets out the specific method for handling violations by Users as follows:

  1. Details and penalties are subject to change by the publisher.
  2. Repeat offenses will result in more severe penalties.
  3. Even if a violation is not listed above, the publisher may still take action against it.
Types and definitions of penalties
Resetting game data: items obtained from prohibited acts, enhancement/transformation counts, etc., and deleting or adjusting experience or achievements
The publisher may delete or adjust part of a game's data if it is difficult to fully calculate the quantity of items obtained from prohibited acts
Account lock: permanently locking, or prohibiting the use of, an account or character for a specified period
Lock: means locking a character. Use of unauthorized software, account takeover, or abnormal transactions will result in a permanent lock.

Steps for a mandatory character name change

  1. Verify the violating name
  2. Rename to "name-date" immediately upon confirming the violation (e.g. violation+0901; if duplicated, append a number after the date)
  3. No need to account for any inconvenience caused to the user who is "kicked" by the rename
